Forklift Certification in Virginia: VOSH Rules, the Seat Belt Directive and Costs
Virginia’s VOSH program adopts federal 1910.178 with two minor edits and adds a directive that makes forklift seat belt use citable. Its penalties adjust every August 1. The rule, the records, the free consultation program, and how online certification fits.
Virginia is an OSHA State Plan state. The Virginia Occupational Safety and Health (VOSH) program, run by the Department of Labor and Industry, covers private employers and state and local government. Virginia adopts the federal general industry standards as “federal identical” rules in 16VAC25-90, and 1910.178 appears there with two minor Virginia edits made in 2006 that do not touch the training paragraph. So the operator training rule in Virginia is 1910.178(l) as written: formal instruction plus practical training plus a workplace evaluation, re-evaluation at least every three years, and an employer certification naming the operator, the training date, the evaluation date and the trainer or evaluator. Virginia adds one thing employers should know: VOSH Program Directive 06-201 says inspectors cite the PPE standard, 1910.132(a), when operators do not use the seat belts their forklifts are equipped with, and removing the belts is itself citable. There is no Virginia forklift license or approved course.
Who Enforces Forklift Rules in Virginia
VOSH, from headquarters in Richmond and field offices in Abingdon, Lynchburg, Manassas, Norfolk, Richmond, Roanoke and Verona, for private employers and state and local government. Federal OSHA keeps federal employers, maritime work and federal enclaves.
The Rule: 1910.178(l) as Adopted in 16VAC25-90
- Formal instruction, practical training and an evaluation of the operator’s performance in the workplace before unsupervised operation (1910.178(l)(1) and (l)(2)).
- Trainers and evaluators must have the knowledge, training and experience to train operators and evaluate their competence (1910.178(l)(2)(iii)).
- Refresher training after unsafe operation, an accident or near-miss, a deficient evaluation, a different truck type or changed workplace conditions (1910.178(l)(4)(ii)).
- Re-evaluation at least once every three years (1910.178(l)(4)(iii)).
- Employer certification with the operator’s name, training date, evaluation date and the identity of the trainer or evaluator (1910.178(l)(6)).
- VOSH Program Directive 02-232A adopts OSHA’s compliance directive on operator training; VOSH Program Directive 06-201 (2005) makes seat belt use on belt-equipped forklifts enforceable under 1910.132(a).
What Is Different From Federal OSHA
| Point | Federal 1910.178 | Virginia VOSH |
|---|---|---|
| Training, evaluation and records | 1910.178(l) | Identical; Virginia’s 2006 edits are to other paragraphs |
| Seat belts | Enforced under the General Duty Clause, case by case | Program Directive 06-201: cited under 1910.132(a) when belts are provided and not used; belt removal citable |
| Serious-violation maximum | $16,550 (2026) | $16,287 (poster revised May 2026; adjusts each August 1) |
| Willful or repeat maximum | $165,514 (2026) | $162,849 (May 2026 poster) |
| Crossing a public road | Not addressed | Va. Code 46.2-678: forklifts crossing highways within ten miles are exempt from registration if the operator holds a driver’s license and the employer complies with OSHA |
Does Virginia Require a Forklift License?
No. VOSH does not license operators or approve courses. The one Virginia statute that mentions forklifts, Va. Code 46.2-678, deals with driving them across public roads and requires an ordinary driver’s license for that, not a forklift license. The certification OSHA and VOSH refer to is the employer’s record.
How Online Forklift Certification Works in Virginia
VOSH does not approve, license or list forklift courses, online or otherwise, and no provider can claim state approval. What the rule asks for is a three-part process: formal instruction, practical training, and an evaluation of the operator on your equipment at your site. An online course covers the first part and documents it. Shield’s forklift course does that in 50 to 70 minutes, in English or Spanish, with a 10-question exam, a downloadable certificate and a phone wallet card with a QR code anyone can verify. The practical training and evaluation are done by someone at your company who knows the trucks, using our printable checklist, and the result is logged on the operator’s record so the certificate, the wallet card and your file all show the evaluation date and evaluator.
Forklift practical evaluation checklist (printable)
Because of Program Directive 06-201, make seat belt use an explicit item in your practical evaluation and operating rules; Shield’s printable checklist already includes it.
Penalties
Va. Code 40.1-49.4 requires an annual inflation adjustment effective each August 1. The Department of Labor and Industry’s job safety poster revised May 2026 lists $16,287 per serious or other-than-serious violation, $16,287 per day for failure to abate, and $162,849 per willful or repeated violation. A new figure is expected to take effect August 1, 2026; check the current VOSH poster.
Free Help: VOSH Consultation Services
VOSH Consultation Services are free for employers with fewer than 250 employees. Call 804-371-2327. In federal fiscal year 2025 the program made 275 consultation visits.
Spanish-Speaking Crews
The Department of Labor and Industry publishes its job safety poster and closing conference guide in Spanish but no Spanish forklift material. OSHA’s forklift QuickCard is available in Spanish. Shield’s course, exam, certificate and wallet card are available in Spanish, and the evaluation checklist prints in either language.
Frequently asked questions
Is online forklift training accepted in Virginia?
Yes, for the formal-instruction part. The employer still provides practical training and evaluates the operator in person on its own trucks, then signs the certification record.
Are forklift seat belts required in Virginia?
If the truck is equipped with one, VOSH cites failure to use it under 1910.132(a) (Program Directive 06-201), and removing belts is citable. Make belt use part of your operating rules and evaluation.
How long is a Virginia forklift certification good for?
The operator must be re-evaluated at least every three years, and sooner after an incident, unsafe operation, a new truck type or changed conditions. Shield certificates are issued for three years.
Do I need a special license to drive a forklift across the street between two of my buildings?
Under Va. Code 46.2-678 the forklift is exempt from registration for crossings within ten miles if the operator holds a driver’s license and you comply with OSHA; no forklift license exists.
